These Terms and Conditions ("Terms") govern your access to and use of the ENO website and the ENO overnight B2B courier service (collectively, the "Services"). ENO is operated by Megative Group ("Company," "we," "our," or "us").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

• "User" — any individual or entity accessing or using the Services.
• "Content" — all text, images, graphics, logos, and other materials available through the Services.
• "Personal Data" — has the meaning given under the GDPR.
• "Services" — the ENO website and overnight courier operations.

4.1 Eligibility

You must be at least 18 years old and acting on behalf of a legally registered business to enter into a partnership.

4.2 Permitted Use

• Use the Services only for lawful purposes
• Do not attempt unauthorized access
• Do not interfere with the integrity of the Services
• Do not transmit malicious code or harmful data
• Do not impersonate any person or entity

5.1 Ownership

All Content and materials available through the Services are the property of Megative Group or its licensors and protected by intellectual property laws.

5.2 Trademarks

The ENO and Megative Group names, logos, and related marks are trademarks of Megative Group. You may not use them without prior written permission.

6.1 Overnight Courier

Partners using ENO agree to provide accurate pickup information, prepared shipments, and access at the agreed pickup window. Delivery times are best estimates within the contractual SLA.

6.2 Liability for Cargo

Cargo handled by ENO is insured per route. Specific limits and exclusions are defined in the partner agreement.

Where applicable, you agree to pay all fees in accordance with your partner agreement. All fees are quoted in Euros unless otherwise specified.

We reserve the right to modify pricing with prior notice. Price changes do not affect routes already booked.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEGATIVE GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability for any claims shall not exceed the amount you paid for the Services in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Megative Group and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or your violation of these Terms.

We may terminate or suspend access to the Services for breach of these Terms. Provisions which by their nature should survive termination shall do so.

We may modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by direct notification.

These Terms shall be governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Leipzig, Germany.

The European Commission provides an Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
